Penders v. Sega

In 2011, Japanese multinational video game company Sega, and American video game company Electronic Arts were both sued by former Archie Sonic comic artist and storywriter Ken Penders for alleged copyright infringement in the 2008 role-playing video game Sonic Chronicles: The Dark Brotherhood. Which was developed by EA's subsidiary BioWare. Specifically, they were accused of plagiarism in Chronicles, mainly due to the characters that debuted in the game, including Shade the Echidna, the Nocturnus Clan being declared of being too similar to Penders' dark legion echidna characters (which consist of Julie-Su, Lien-Da, Dimitri and others).

Lawsuit

On May 31, 2011, after Penders collected every similarity to Archie he could find in Chronicles, Penders officially went ahead and filed a heated lawsuit at Sega and EA for alleged copyright infringement in Chronicles.


On September 26, 2011, the case was dismissed, and Judge Otis D. Wright asked Penders to finish Archie's lawsuit against him, as THAT case's ruling is affecting this case. But despite Wright's warning, Penders ignored the wishes and refiled the case four days later, but that same day it was dismissed by the judge once more.


Later, that same year, the Statue of Limitations expired, prompting the settlement to be reached.
